Copyright takedown notice

Under the Hong Kong Copyright Ordinance (Cap. 528)

1. Governing framework

This platform operates as an online service provider within Hong Kong. Complaints concerning alleged copyright infringement in user- or third-party-submitted content are governed by the Hong Kong SAR Copyright Ordinance (Cap. 528). Sections 88A–88H set out the online-service-provider safe-harbour conditions, including the procedures for takedown upon valid notice and for counter-notice.

2. Designated agent

Notices under Cap. 528 §88B must be submitted in writing to the designated agent below:

3. What the notice must contain

  1. Identification of the copyrighted work claimed to be infringed (title, author, year of publication).
  2. Identification of the material to be removed (full URL on this platform).
  3. The complainant's contact information (full name, address, telephone, email).
  4. A statement of good-faith belief that the use complained of is not authorised by the copyright owner and is not otherwise lawful.
  5. A statement that the information in the notice is accurate and that the complainant is the copyright owner or authorised to act on the owner’s behalf.
  6. The complainant's physical or electronic signature.

4. Counter-notice

If your content has been removed and you believe the removal was in error, you may submit a counter-notice to the designated agent above under the counter-notice procedure contemplated by Cap. 528 §88C. We forward valid counter-notices to the original claimant; absent a court order from a court of competent jurisdiction, the content may be restored a reasonable period (typically 10–14 business days) after the claimant is served with the counter-notice.

5. Repeat infringers

The platform terminates accounts or listing sources of repeat infringers in appropriate circumstances.

6. Liability for misuse

Under Cap. 528, a person who knowingly makes a material misrepresentation in a takedown notice or counter-notice may be liable to the affected party for damages sustained as a result (including this platform's reasonable legal costs).
